Gary Johnson has established residency at 311 12th Ave. Northeast in Stewartville.
Johnson, a local business owner for 33 years, is running for mayor against incumbent Jimmie-John King, who has served as the city's mayor since January 2009 and ran unopposed in 2008, 2012 and 2016.
Johnson, who recently lived in Rochester, initially listed 302 S. Main Street as his address on his affidavit for candidacy, which he filed in August. That's the address of a building he owns that houses two local businesses.
To be a viable mayoral candidate, Johnson was required to establish residency in Stewartville on or before Saturday, Oct. 3, which is 30 days before the Nov. 3 election. Johnson wouldn't have established residency by living in the building he owns.
In a Monday, Sept. 28 email to Melanie Leth, city attorney, Johnson wrote that in an earlier correspondence with Leth, the city attorney had determined Johnson's property at 302 S. Main Street was not a legal residence for a mayoral candidate. In his email, Johnson also referred to Leth's earlier determination that if Johnson wanted to be a viable candidate and live in the B1 downtown commercial district, he would have to live on the second level of a downtown business...
