For the second time since July, city officials have declared three of Daniel Ware's trees hazardous and have ordered the 84-year-old to remove them from his property.
In a 4-0 vote last week, the City Council directed Ware to remove two ash trees from his back yard and a silver maple tree from his front yard at 519 Fifth Avenue Southeast.
Mayor Jimmie-John King and councilpersons Craig Anderson, Brent Beyer and Jeremiah Oeltjen all agreed that Ware must remove the trees. Councilperson Josh Arndt was absent.
On Sept. 10, 2019, the City Council adopted a hazardous tree ordinance that requires Stewartville residents to remove hazardous trees from their properties within 45 days of being notified by the city.
After receiving complaints from Ware's neighbors, the city hired an arborist to evaluate four trees on the Ware property. The arborist, who used the ISA Basic Tree Risk Assessment, determined that three of the four trees were hazardous and needed to be removed.
On Friday, April 24, city officials sent Ware a letter explaining that the three trees, including the two ash trees and the one silver maple tree, had been marked with an orange X for removal...
